University of California, Hastings College of the Law (UC Hastings or Hastings) is a public law school in San Francisco, California, located in the Civic Center neighborhood.
I. Introduction to the BCDC, the McAteer-Petris Act (MPA), the SF Bay Plan, and the requirements of the Act and Plan that any activity that requires a permit under the Act must, in order to qualify for such a permit, provide “maximum feasible public access, consistent with a proposed project…to the shoreline and waters of the San Francisco Bay” (MPA § 66602).
However, Section 66606 of the MPA precludes the BCDC from exercising its authority in a way that “will take or damage private property for public use, without the payment of just compensation therefor.” In the event of a conflict between Sections 66602 and 66606, the latter will prevail.
